Terms of Service

This is version 1 of our terms, published so our legal pages have stable URLs. It is pending final owner and legal review; the company entity name and governing law stated below are placeholders subject to correction in a future revision.
1. Acceptance of these terms
These Terms of Service ("Terms") are an agreement between you and Ziftr, Inc. ("Ziftr", "we", "us"), the company behind Aimee. By creating an account, accessing ziftr.ai, or using any Aimee product -- including the commerce platform, admin dashboard, APIs, SDKs, the Aimee assistant, and the Aimee MCP gateway (together, the "Services") -- you agree to these Terms. If you use the Services on behalf of a company, you represent that you can bind that company.
2. The Services
Aimee is Ziftr's AI Marketing & E-Commerce Engine: storefront and admin tooling, commerce APIs and SDKs, and AI features that help you build and operate online stores. The MCP gateway exposes Aimee documentation and developer tools to AI clients (such as Claude) over the Model Context Protocol, authenticated with OAuth 2.0.
3. Accounts and eligibility
You must be at least 18 years old and provide accurate account information. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.
4. Acceptable use
You agree not to:
- Use the Services for unlawful, fraudulent, or deceptive activity, or to sell prohibited goods
- Probe, breach, or circumvent authentication or security controls
- Interfere with the integrity or performance of the Services, including rate-limit evasion
- Access the Services to build a competing product, or scrape them beyond documented API usage
- Upload malicious code or infringe the intellectual-property or privacy rights of others
We may suspend or terminate accounts that violate this section.
5. Fees and payments
Any applicable fees are disclosed before you incur them. Payment processing is provided by Stripe and subject to Stripe's terms. Merchants are responsible for applicable taxes on their own sales.
6. Your data and privacy
You retain ownership of the data you and your customers submit to the Services ("Customer Data"). You grant Ziftr a license to host and process Customer Data solely to provide the Services. Our handling of personal data is described in the Privacy Policy. You are responsible for having the necessary rights and notices to submit Customer Data.
7. Intellectual property
Ziftr and its licensors own the Services, including all software, design, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms. Open-source components remain governed by their own licenses.
8. AI and beta features
AI features -- including the Aimee assistant and MCP gateway -- generate output with machine-learning models provided by third parties such as Anthropic. Output may be inaccurate or incomplete; review it before relying on it, especially for pricing, legal, or financial decisions. Features labeled beta, preview, or pilot are provided as-is and may change or be withdrawn at any time.
9. Third-party services
The Services interoperate with third-party services, including AWS (hosting), Stripe (payments), SendGrid (email), and Anthropic (AI models). Your use of a third-party service is governed by that party's own terms, and Ziftr is not responsible for third-party services.
10. Disclaimer of warranties
The Services are provided "as is" and "as available." To the maximum extent permitted by law, Ziftr disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
11. Limitation of liability
To the maximum extent permitted by law, Ziftr will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Ziftr's total liability for claims arising out of the Services will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred US dollars (USD $100).
12. Indemnification
You will indemnify and hold Ziftr harmless from claims arising out of your Customer Data, your use of the Services in violation of these Terms, or your violation of law or third-party rights.
13. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate access for breach of these Terms, for legal or security reasons, or upon notice if we discontinue the Services. Sections that by their nature should survive termination (including 6-12) survive.
14. Governing law
These Terms are governed by the laws of the State of New Hampshire, USA, excluding its conflict-of-laws rules. Courts located in New Hampshire have exclusive jurisdiction over disputes arising from these Terms, and each party consents to their jurisdiction.
15. Changes to these terms
We may update these Terms from time to time. We will post the revised version at this URL and update the "Last updated" date above; material changes will be communicated to account holders. Continued use of the Services after changes take effect constitutes acceptance.
